Terms of Service for Softworks Digital
Welcome to Softworks Digital Int’l Ltd! By engaging with our services, you agree to the following terms and conditions. Please read them carefully before proceeding.
1. Scope of Services
We provide web design and development services as outlined in our predefined packages. Additional services (e.g., SEO, content creation, custom features etc.) may be offered at an extra cost.
2. Payment Terms
- Fixed Pricing: Our packages are offered at fixed prices as advertised. However, prices may vary if additional features or services are requested as add-ons.
- Payment Schedule: A deposit of 50% is required to begin work, with the balance due upon project completion. This may vary for custom projects
- Refunds: A money-back guarantee applies only to small business packages and is valid within 30 days of project completion, provided the client has not requested additional features beyond the package scope.
3. Project Timelines
- Timeline Dependence: All project timelines are based on the prompt availability of content, materials, and feedback from the client. Delays in providing required information may extend the project timeline.
- Revisions: Each package includes a set number of revisions. Additional revisions may incur extra charges.
4. Package Features
- Feature Availability: Features listed within a package are available to be added but are not mandatory. They will only be included where necessary and agreed upon by both parties.
- Add-Ons: Additional features or services not included in the selected package will be charged separately.
5. Hosting and Domain
- Free Hosting and Domain: Hosting and domain services are provided free for the first year for small business and corporate packages. Custom packages are exclusive of free domain and hosting.
- Renewal: After the first year, the client is responsible for renewing hosting and domain services. We will notify you before the renewal date.
- Third-Party Hosting: If the client chooses to use a third-party hosting provider, we are not responsible for any issues arising from their services.
6. Client Responsibilities
- Content Provision: The client is responsible for providing all necessary content (e.g., text, images, logos) in a timely manner.
- Accuracy of Information: The client must ensure that all provided content is accurate, legally compliant, and free of copyright violations.
- Feedback: The client agrees to provide timely feedback during the design and development process to avoid delays.
7. Intellectual Property
- Ownership: Upon full payment, the client owns the final website design and content. Softworks retains the right to showcase the work in our portfolio unless otherwise agreed in writing.
- Third-Party Tools: Any third-party tools, plugins, or software used in the project are subject to their respective licensing terms.
8. Limitation of Liability
- Softworks is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website.
- The client is responsible for ensuring their website complies with local laws and regulations.
9. Termination
- Either party may terminate the project with written notice. If the client terminates the project, they are responsible for payment for all work completed up to the termination date.
- Softworks reserves the right to terminate the project if the client fails to provide necessary content, feedback, or payments in a timely manner.
10. Confidentiality

11. Amendments
- These terms may be updated periodically. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

13. Maintenance and Support
- Post-Launch Support: Free support is included for 30 days after the website goes live. After this period, maintenance and support services are available at an additional cost.
- Client Responsibility: Clients are responsible for updating and maintaining their website unless a maintenance plan is purchased.
14. Force Majeure
- Softworks is not liable for delays or failures in performance caused by circumstances beyond our control, such as natural disasters, pandemics, or internet outages.
15. Acceptance of Terms
- By making a payment or providing content for the project, the client agrees to these terms and conditions.
